IRS Erred with Form 5500 Extension Requests

The Internal Revenue Service announced that some requests for an extension of Form 5500 filing have been inadvertently denied and plan sponsors received denial letters in error.

The agency said its Ogden Campus received numerous Forms 5558 requesting an extension from plan administrators still in the process of updating their systems for newly required electronic filing on the EFAST2 system. But some plan sponsors received a CP 216H notice, Application for Extension of Time to File an Employee Plan Return Denied – Not Timely, in error.  

The agency has taken the necessary steps to correct the issue, and is asking sponsors that believe they received a CP 216H Notice in error, to send the denial letter and proof that the original Form 5558 was postmarked timely (for example, express mail or certified mail receipt) to the IRS’s Ogden office. The address is Ogden Accounts Management Center; EP Accounts Unit, Mail Stop 6270; Ogden, Utah 82401.
